NexusCaller

AI Phone Receptionist — Terms of Service

Version 1.3 · Effective October 24, 2026 · NexusCaller LLC, California, USA · info@nexuscaller.com

These terms apply to NexusCaller's AI Phone Receptionist service at app.nexuscaller.com ("the Service"). By creating an account or using the Service, you agree to them on behalf of the business you represent ("you"). Our Privacy Policy and Data Processing Agreement form part of these terms.

1. The Service

NexusCaller provides an AI receptionist that answers your business's incoming phone calls. We read your public website to prepare it and provide a phone number for it. The receptionist answers callers using information you provide or that we read from your website. Calls are recorded and transcribed, and an AI-generated summary of each call — who called, what they need and whether a follow-up is needed — is emailed to you. If you add a staff phone line, the receptionist can transfer calls to it. The Service answers incoming calls only; it does not place outbound calls.

Your plan also includes NexusCaller's AI Website Chat for your website. Your use of the chat is also governed by the AI Website Chat Terms of Service, except their sections on the free trial, plans and billing, and cancellation: the chat is part of your plan and is billed under these terms.

2. Accounts

The Service is for businesses. You must be at least 18 and authorized to act for the business, and you must give accurate information. Keep your login private; you are responsible for activity in your account, including by people you give access to.

3. Your website and content

When you submit a website, you confirm that you own it or are authorized by its owner to have it read and used for a phone assistant. You grant us a license to copy, store and process that website's public pages and any content you add, only to provide the Service to you. You must not submit a website you have no right to use; we may suspend receptionists built from someone else's website.

4. What the receptionist says

The receptionist's speech is generated by artificial intelligence. It can mishear callers, transcribe or summarize a call incorrectly, and give answers that are wrong or incomplete. You are responsible for reviewing its knowledge and instructions, for what it tells your callers, for honoring or correcting it, and for following up on calls. Do not use it to give medical, legal, financial or other professional advice without appropriate disclaimers and human oversight. The receptionist must never present itself as a licensed health or other professional (for example, a doctor, nurse, therapist or lawyer), and you must not instruct it to do so.

5. Acceptable use

You must not use the Service, or a phone number we provide, to:

You must not use the Service if you are a HIPAA covered entity or business associate, unless we have signed a Business Associate Agreement with you. The Service is not designed to receive or store health information.

6. Notices to your callers

Every call starts with a fixed spoken notice telling callers that the call is answered by an AI assistant and is recorded. It plays automatically before the receptionist speaks, and you cannot remove, shorten or replace it.

Some laws require every party to a call to be informed of, or to consent to, its recording — including California (Penal Code § 632) and other all-party-consent states. The notice is designed to help you meet these requirements, but you remain responsible for complying with the call-recording, consent and AI-disclosure laws that apply to you and your callers, for giving any additional notice or obtaining any consent they require, and for informing your own staff who take transferred calls. Your privacy policy should mention that calls to your line are answered by an AI assistant and recorded.

7. Free trial

New accounts get a 7-day free trial with up to 60 call minutes. By default, you add a payment card in Stripe Checkout when you start the trial: unless you cancel before the trial ends, your card is charged for the plan you selected when the trial ends, and the subscription then renews monthly. You can cancel during the trial under Account & billing at app.nexuscaller.com without being charged. If your trial was started without a payment card, the receptionist stops answering calls when the trial ends until you choose a paid plan; your setup is kept.

8. Plans and billing

Paid plans are billed monthly in advance through our payment processor, Stripe, at the prices shown when you subscribe. Current plans:

PlanPriceCall minutes included per month
Starter$149/month300
Pro$349/month900
Business$599/month1,800

Prices exclude applicable taxes. Plans renew automatically each month until cancelled. Calls are counted by the started minute (for example, a call lasting 2 minutes 5 seconds counts as 3 minutes). Test calls made from your dashboard do not count. Included minutes reset at the start of each billing period, and unused minutes do not carry over. When your minutes (including trial minutes) are used up, callers hear your "closed message" until your minutes reset or you upgrade. Plan changes take effect immediately and are prorated. Removing call forwarding or receiving no calls does not pause billing. We may change prices with 30 days' notice; changes apply from your next billing period.

9. Phone numbers and call forwarding

As part of the Service, we obtain a U.S. phone number for your receptionist through our telephony providers (Vapi or Twilio). The number is provided for use with the Service only; it remains NexusCaller's and is not transferred or assigned to you. We do not currently port numbers into or out of the Service, so you cannot move an existing number to the Service or take the Service's number with you.

If you forward your existing business number to the receptionist, setting up and removing that forwarding is your responsibility, as are any charges your phone carrier makes for it. When the Service ends, remove the forwarding so your callers can still reach you. We may release the number 30 days after the Service ends, after which it may be assigned to someone else.

10. Cancellation and refunds

You can cancel at any time under Account & billing at app.nexuscaller.com ("Manage billing"). Cancellation takes effect at the end of the current paid period (or, during a free trial, at the end of the trial), after which the receptionist stops answering calls. We do not refund partial months, except where the law requires it.

11. Your data

Calls, recordings, transcripts and summaries are deleted automatically 12 months after the call, both in our systems and at our voice platform provider, Vapi. After your account is closed, we delete your receptionists, knowledge and calls within 30 days, except records that the Privacy Policy says we keep longer (billing records, sign-in and audit logs, and records of your acceptance of these terms). How we handle personal data is set out in our Privacy Policy and Data Processing Agreement.

12. Availability and emergencies

The Service relies on third-party telephony, voice AI, hosting and email providers. It is provided "as is" and "as available", without a guarantee of uptime, that every call will be answered or connected, or of the accuracy of AI responses, transcripts or summaries. We may change AI models or providers to keep the Service running. We recommend that you keep another way for callers to reach you if the Service is unavailable.

The Service is not an emergency service. It cannot connect callers to emergency services. Anyone with an emergency must hang up and dial 911 (United States), 112 (European Union) or their local emergency number directly.

13. Suspension and termination

We may suspend or close an account for non-payment, breach of these terms, abuse, or a legal or security risk, with notice where practical. You may close your account at any time. To close your account, cancel your plan under Account & billing and email info@nexuscaller.com; we delete your data as described in the Privacy Policy.

14. Liability and indemnity

To the extent the law allows: (a) neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, business or data, including from missed, dropped or misunderstood calls; and (b) our total liability arising from the Service is limited to the fees you paid us in the 12 months before the claim. You will indemnify NexusCaller against third-party claims arising from your website content, your receptionist's instructions or knowledge, your compliance with call-recording, consent and disclosure laws, or your breach of these terms. Nothing in these terms limits liability that cannot be limited by law.

15. Changes to these terms

We may update these terms. We will notify you by email or in your dashboard at least 30 days before a material change takes effect, and may ask you to accept the new version to keep using the Service.

16. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules, and disputes will be resolved in the courts of California. If you are established in the European Union, this does not remove protections that mandatory EU or national law gives you.
